
This document is a mandatory policy – all employers are legally required to have a disciplinary procedure. Without one, any disciplinary action you take risks being challenged as unfair at Employment Tribunal.
This template sets out a clear, step-by-step procedure for managing conduct issues, from informal conversations through to formal warnings and dismissal. It is drafted in line with the ACAS Code of Practice on Disciplinary and Grievance Procedures, compliance with which Employment Tribunals are required to take into account. A failure to follow the Code can result in a compensation uplift of up to 25%. The template covers:
- Informal action and the purpose of early intervention
- The formal disciplinary process – investigation, hearing, outcome
- The full range of sanctions: verbal warning, written warning, final written warning, and dismissal
